Back to all servicesHow to Conclude a Child Support Agreement?
Faced with the need to claim child support and must act quickly? Law Firm “ES&Partners” provides qualified legal assistance and will promptly and professionally draft an agreement. Both parents are obliged to participate in the upbringing of the child and support them until reaching adulthood (Art. 180 of the Family Code of Ukraine).
Please note that Ukrainian legislation provides the following methods for claiming child support:
- Conclusion of a child support agreement, specifying the amount and timing of payments. The terms must not violate the child’s rights as established by the Code. The agreement must be in writing and notarized;
- Based on a court decision.
A child support agreement resolves many misunderstandings between parents, setting clear terms and amounts, whereas court proceedings can take significant time.
An essential condition of the agreement is the determination of the child’s place of residence, which must coincide with the residence of one of the parents. That parent will be the recipient and administrator of the support funds, using them solely for the child’s benefit (Part 1 of Art. 179 of the Family Code of Ukraine).
In a child support agreement, our legal experts will include the following essential provisions:
- Amount of support (no less than 50% of the subsistence minimum for a child of the corresponding age) and specific payment deadlines;
- Procedure and schedule for visits with the child;
- Recovery of child support based on a notary’s enforcement inscription in case one parent fails to meet their obligations.
