What is land plot allocation?
It refers to the set of measures for forming a land plot, defining its boundaries, and transferring it into use or ownership.
The procedure for land plot allocation includes several stages:
- Obtaining a permit for the development of a land allocation project;
- Development of the land allocation project;
- Approval of the land allocation project by the local office of the StateGeoCadastre and other relevant authorities;
- State registration of the land plot in the State Land Cadastre;
- Approval of the land management project for land allocation by the territorial body of the central executive authority responsible for implementing state land policy;
- Registration of ownership rights to the land plot in the State Register of Property Rights to Real Estate.
According to Article 50 of the Law of Ukraine “On Land Management,” land management projects for land plot allocation are developed in the following cases:
- Formation of new land plots from state or communal lands (except when formed on the basis of other land management documentation);
- Change of the designated use of land plots in cases stipulated by law.
Land management projects for land plot allocation may also include the division or merger of land plots owned by one individual.
